The 49ers released a statement last Thursday, indicating they were not going to cut Reuben Foster — at least for the time being — shortly after he was charged by the Santa Clara County DA’s office for three felonies, including domestic violence.

On Sunday, the 49ers released another statement, this one authored by CEO Jed York, general manager John Lynch, and head coach Kyle Shanahan, clarifying that they’re going to let the legal process play out before making a decision on Foster, but also stating that he will not participate in the team’s offseason program which begins on Monday.

Via 49ers official press release:

“Reuben Foster will not participate in team activities as he is tending to his legal matters. As previously stated, his future with the team will be determined by the information revealed during the legal process.”

In addition to the domestic violence charge, Foster is also currently charged with forcefully attempting to prevent a victim from reporting a crime, and possession of an assault weapon, according to the district attorney. The charges were made by Foster’s girlfriend, after an incident that took place on February 11. Foster faces up to 11 years in prison of he’s convicted on all three charges.
